Products Liability

Our experience representing clients in personal injury matters includes taking on numerous major manufacturers and suppliers in serious products liability cases, involving significant injuries, damages, and even deaths.

We believe in corporate responsibility and in holding companies accountable for dangerous and defective products they have designed, manufactured or placed in the market.  Our lawyers have the knowledge, experience and financial resources to successfully take on the largest adversaries.  The following cases are a sampling of some of the matters we have handled:

In White v. Ford Motor Company, we won over $150 million against the Ford Motor Company on behalf of Jimmie and Ginnie White, whose three-year-old son, Walter, died when his parents' 1993 Ford F-350 truck rolled over him despite the parking brake having been engaged.  Peter D. Durney, co-counsel in the case, was able to establish that Ford knew about the defect but tried to avoid notifying consumers.  Counsel for the Whites argued that Ford issued notices only after it had been pressured to do so by the National Highway Traffic Safety Administration.  At the conclusion of the trial, the four-woman, four-man jury found Ford responsible for Walter's death; had a 15-cent plastic wedge been installed in time to fix the defective parking brake, his life could have been spared.

Another high-profile products liability case, Tinnin v. Western States Propane, involved the Tinnin family, who were co-represented by Thomas R. Brennan.  On January 20, 1996, the Tinnin family, who were staying in a travel trailer while their new home was being built, suffered a gas explosion due to leaking gas.  The Tinnins' four-year-old child, Kyla Tinnin, died, and the surviving family members suffered severe second and third degree burns to over 80 percent of their bodies.  Despite the defense's argument that there was no industry mandate to replace older gas equipment, the jury found in favor of the Tinnins, awarding them over $52 million in damages.
